Mother files suit against driver and vehicle owner after daughter’s death

(WBNG) -- The mother of an Owego teen who was killed in a vehicle and bicycle crash in the summer of 2019 has filed a lawsuit against two people for wrongful death and negligence.

According to court documents filed in Broome County Supreme Court, Sharon Pond of Owego is suing Michael E. Gincerowski of Gowanda, N.Y. and Eric A. Richards of Delanson, N.Y. in connection to the death of Connie Mazzarese.

Mazzarese died in June of 2019 when Gincerowski, then 44-years-old, struck and killed her after he swerved into a lane on Route 369 in the town of Fenton around 10 p.m. Mazzarese was riding her bicycle.

He pleaded guilty to vehicular manslaughter and aggravated DWI, both felonies, and was subsequently sentenced to five to 15 years in prison.

According to the court documents, Richards was the owner of the 2005 Ford that struck Mazzarese. The document says Richards "negligently
entrusted" Gincerowski with the vehicle.
