Off-duty upstate NY officer in fatal shooting resigns, pleads to DWAI

UTICA, N.Y. (AP) — An off-duty Albany police officer who fatally shot a man who tried to rob him at a prostitute’s home in Utica has resigned and pleaded guilty to driving while ability impaired.

The Albany Times Union reports that Christofer Kitto pleaded guilty to a lesser charge of DWAI Tuesday to satisfy a charge of patronizing a prostitute. He and his attorney declined to speak to reporters as they left court in Utica.

Kitto has not been charged with the January shooting death of 35-year-old Shatelle Hooks of Syracuse. Police say Kitto had been at the nearby Turning Stone Casino before going to meet a prostitute, and that Hooks tried to rob him.

Utica police and Oneida County District Attorney Scott McNamara said their investigation of the shooting is ongoing.
